Kanicen Nix – Terms & Conditions

These Terms and Conditions govern your booking and participation in Kanicen Nix Fishing Classes, Workshops, and related services (collectively referred to as the "Programs"). By booking a class or workshop through our website or other official channels, you agree to be bound by these Terms and Conditions. Please read carefully and keep a copy for your records.

1. About Us

Kanicen Nix is a Malaysia-based ultralight fishing academy, providing online and on-site classes, workshops, guided trips, and coaching sessions. 2. Eligibility

By booking a program, you warrant that: 1. You are legally capable of entering into binding contracts under Malaysian law. 2. You are at least 12 years old for online classes or 18 years old for on-site and overseas programs (participants under 18 must have parental consent). 3. You will comply with all safety instructions and program requirements.

3. Booking & Contract Formation

1. All bookings are subject to availability. 2. Your booking constitutes an offer to participate in the program. 3. A contract between you and Kanicen Nix is formed only when we confirm your booking in writing (via email or WhatsApp confirmation). 4. The confirmed program will include the class date, format, venue (if applicable), equipment provision, and any special instructions.

4. Payments & Fees

1. Program fees are as listed at the time of booking. All prices are in Malaysian Ringgit (RM). 2. A 30% deposit is required to secure your spot (for applicable program/classes). The balance is due 14 days before the program date. 3. For some programs, full payment is needed to reserve your spot. Complete your payment to secure your place and guarantee your participation. 4. Payment methods include online bank transfer, credit/debit card, or other approved payment channels. 5. Fees are non-transferable unless approved in writing by Kanicen Nix.

5. Cancellations & Refunds

1. Full Refund: Cancel at least 7 days before the program date. 2. No Refund: Cancellations made less than 7 days prior to the program date. 3. Programs cancelled by Kanicen Nix due to force majeure (e.g., weather, natural disasters, government restrictions) will be rescheduled or a full refund provided. 4. Any refund will be processed using the original payment method within 14 working days of cancellation. 5. No refund: For downloadable items (pdf, videos, ebook, etc).

6. Program Participation & Conduct

1. Participants must follow all safety guidelines and instructions provided by instructors. 2. Kanicen Nix reserves the right to deny participation or remove participants who fail to comply with safety standards or behave inappropriately. 3. For minors, a parent or guardian must supervise during practical on-site sessions.

7. Equipment & Liability

1. For on-site programs, ultralight rods, reels, and necessary gear will be provided to beginners. 2. Participants must handle all equipment responsibly. Any loss or damage caused by negligence may be charged to the participant. 3. Kanicen Nix is not liable for personal injury, illness, or property damage during programs, except in cases of proven negligence by our instructors. 4. Participation is at the participant's own risk, including fishing in rivers, lakes, or offshore locations.

8. Intellectual Property

1. All materials, presentations, and digital content provided during classes remain the property of Kanicen Nix. 2. Participants may use materials for personal learning purposes only and must not reproduce, distribute, or sell any materials without prior written permission.

9. Overseas & Group Programs

1. Participants in overseas trips must comply with local laws, customs, and travel regulations. 2. Travel, accommodation, and insurance costs for overseas programs are the responsibility of participants, unless otherwise specified. 3. Group or corporate programs may require custom terms, agreed in writing prior to the event.

10. Force Majeure

Kanicen Nix is not responsible for delays or cancellations caused by events beyond reasonable control, including but not limited to: • Severe weather or natural disasters • Government regulations, restrictions, or travel bans • Illness, epidemic, or pandemic restrictions • Transportation or logistical disruptions In such cases, we will reschedule programs or issue a full refund at our discretion.

11. Governing Law & Jurisdiction

These Terms and Conditions are governed by Malaysian law. Any disputes arising from bookings or program participation will be resolved under the non-exclusive jurisdiction of the Malaysian courts.

12. Changes to Terms

Kanicen Nix reserves the right to amend these Terms and Conditions at any time. Any changes will apply to future bookings only. Existing confirmed bookings will be governed by the Terms in effect at the time of booking, unless legally required to apply the new terms.

13. Privacy & Communications

1. Participant information is collected for program administration, communication, and safety purposes. 2. We may contact you via email, WhatsApp, or phone regarding class updates, booking confirmations, or promotional materials. 3. We comply with Malaysian data protection laws, including PDPA 2010.

14. Severability & Waiver

1. If any provision is found invalid or unenforceable under Malaysian law, the remaining provisions will continue in full force and effect. 2. Failure by Kanicen Nix to enforce any provision does not constitute a waiver of that provision.
